School of Motoring and Your Instructor

Your instructors are self-employed franchisees to the driving school. The driving school acts as an agent for instructors to book pupils in and to receive payments. Pupils however can make payments made to their instructor. The driving school whenever necessary supplies information and documentation to the pupil and processes their payments for lessons on behalf of the instructor. The contract for the driving lesson is solely between the pupil and their instructor.

Lessons

The pupil and their instructor are responsible for agreeing on all lesson matters times, locations, and duration of individual lessons

Cancellation of lessons

If a pupil wishes to cancel a lesson, a minimum of 48 hours prior notice must be given. If your instructor cancels a lesson, the instructor shall rearrange the lesson. Cancellations preferable must be made directly between the pupil and their instructor. If the pupil does not give at least 48 hours notice of cancellation, they will be charged for the lesson(s) concerned in full.

Use of Elliott’s Cars for Test

Elliott’s Cars can only be used for your driving test if in your instructor’s opinion you meet the required test-ready standard. The instructor has the right to refuse to take you for their driving test if in their opinion you are not yet at the driving test standard. In cases where you had to have a driving assessment and if the result of your assessment is not what you expected, you can request a second assessment from another instructor with the school. (please note, all assessment is at your own cost)

Payments and lesson bookings

Any lesson of 2 or more hours, must be fully paid for in advance at least 48 hours prior to the start of the lesson by using one of the following methods:

  • Payment by credit or debit card
  • A driving School gift card or Cash
  • Vouchers and gift cards have no cash value and have to be redeemed against lessons
  • Vouchers and gift cards are not transferable once they have been redeemed
  • Payment by cash or cheque direct to your instructor (any cheque must be made payable to your instructor)
  • Elliotts School of Motoring has no responsibility or liability for pupil’s payments made by any other means.
  • If the pupil pays an instructor directly by any method, they should obtain a receipt or payment signed off on their payment card.
  • Elliotts School of Motoring accepts no responsibility for any payments made directly to instructors.

Price changes

The cost of a prepaid lesson is based on the lesson price in force at the time of booking and, except for the circumstances set out below, will be honoured for 12 months thereafter irrespective of any price increase that may occur between the date of booking and when the lessons are taken. Any unused lessons remaining after 12 months have elapsed shall have any lesson price increase applied prior to the lessons, which shall become payable by the pupil.

Special offers and discounts

Elliotts School of Motoring from time to time has a range of offers and discounts for new and existing learner pupils. The company reserves the right to introduce and withdraw special offers and discounts at anytime

Our introductory offers are only available to new learners who have never driven in their life before. Anyone who has taken up the offer and has shown to have driven in the past is subject to the full recovery of the cost of the lesson taken. Your instructor reserves the right to hold on account up to 2 lessons on this introductory offer. Anyone who has taken up the offer and has shown to have driven is subject to the full recovery of the cost of the lesson taken.

Lesson Start and Finish Times

Your Driving Instructor will make every effort to meet your lesson time as planned. However, this depends on varied traffic conditions, hence you are asked to be prepared to start within the scope 15 minutes earlier or later than the time booked. Irrespective of the time of arrival of your Instructor, you will receive your full lesson. If your instructor arrives outside the allocated 15 minutes scope, you will have the right to refuse the lesson, and you will not be charged. However, if you choose to take on the lesson outside the allocated 15 minutes scope, you have then entered into a new lesson start and finish time agreement, hence annulling the prior start and finish time agreement.

Please note that your driving lesson starts at the time your instructor arrives at your address and finishes when you exit the vehicle. This means you must be ready for when your instructor arrives, as any length of time you take from your instructor’s arrival, and you reach the vehicle will be included in your lesson.

Whenever you are looking to take on a lesson, Elliotts School of Motoring strongly recommends that you provide enough gaps between your lesson and your next appointment, so to cater for any unforeseen issues. In cases where you don’t provide enough gaps, neither the driving school nor your instructor can be held responsible, hence both the driving school and your instructor are indemnified.

Refund policy and warranty

Pupils are entitled to cancel prepaid lessons at any time (provisions relating to cancellation, see ‘Cancellation of lessons’ above). If the pupil has not taken any lesson(s) at the time of cancellation, they are entitled to a refund of the amounts paid to Elliotts School of Motoring, subject to the points below.

  • An administration fee of £15
  • If the pupil has taken lesson(s) at the time of cancellation, the pupil will not be eligible for a refund on any lessons taken.
  • A refund request must be within 6 weeks of the completion date of the last lesson taken
  • Elliott’s School of Motoring reserve the right to refund pupil by any method deemed appropriate
  • Elliott’s School of Motoring may request additional information from you to confirm your identity in order to comply with the Money Laundering Regulations 2007
  • We will also use this information to ensure adherence to Our Merchant Operating Instructions for card collection facilities.
  • Refunds can be by cheque, bank transfer or any other method deemed appropriate and can take up to 10 working days.

The prices of both manual and automatic lessons are displayed on the home page of this website.
Introductory offers and special offers packs are non-refundable but are transferable within the driving school.

  • Discounts on bulk purchases are discretionary and can be removed at any time.
  • The discount is given over the complete block and not on individual lessons.
  • Refund of partial block booking shall be calculated based on the rate set against the number of lessons taken. (example: if only 5 lessons are taken from a block of 10 lessons purchased, refund calculation will be based on the charges set for a block of 5 to 9)
  • In the event of a ‘buy one, get one free, no refund will take place once the first lesson has been taken
  • If the pupil has paid using a prepaid gift card or voucher, we will not be able to proceed to any refund after the redemption of the card or voucher.
  • If the pupil has paid their instructor for the lesson they wish to cancel, their instructor will refund, adhering to the same principles as set out above.

Transferability of lessons

A pupil cannot sell or transfer lessons that have been purchased in their own name to any other person.

Fraud prevention

Pupil lessons are only valid if they are purchased through the channels outlined in the ‘Payments and lesson bookings’ section set out above. In the event that lessons were not purchased in accordance with the foregoing terms, Elliotts School of Motoring reserve the right to suspend these lessons with immediate effect. An investigation will then be conducted by us in order to check the validity of the purchase. Where the results of the investigation determine that the lessons are not valid they will not be given and Elliotts School of Motoring shall have no liability in these circumstances.

Limitation of liability

Elliotts School of Motoring and its instructors are not liable to the pupil for any loss or damage caused where, and to the extent that there is no breach of a legal duty owed to the pupil by the relevant person or body; such loss or damage is not a reasonably foreseeable result of such a breach; any such loss or damage, or increase in the same, results from any breach or omission by the pupil any such loss or damage results from circumstances or matters outside the reasonable control of the relevant person or body. Elliotts School of Motoring and its instructors shall not, in any event, be liable for losses relating to any business interests pupils may have including, without limitation, lost profits, lost earnings, loss of opportunity, or business interruption. The pupil is reminded that Elliotts School of Motoring is not a party to the contract for the driving lesson itself, which is between the pupil and their instructor. This does not affect any liability that Elliotts School of Motoring may have for any loss or damage the pupil may incur which is caused directly as a result of any breach (including negligence) by it or them of any legal duty owed by it or them to the pupil. Nothing in these terms and conditions will affect any statutory rights a pupil may have as a consumer.

Insurance

The instructor will carry the appropriate motor insurance, should you be involved in a collision as a learner driver while in control of driving instructor’s tuition vehicle.

Law applying to terms and conditions

These terms and conditions are governed by the laws of England and Wales and are subject to the non-exclusive jurisdiction of the British courts.

Complaints Procedure

Elliott’s School of Motoring aims to resolve all concerns raised by the pupil immediately and informally before the matter becomes the subject of a formal complaint. Your driving is a contract between yourself and your driving instructor, should you have any complaints or are not happy in any way with your training, or any other part of the service that you are given, these matters should first be taken up directly with your instructor. If your concerns or complaints cannot be resolved with your instructor, you should then refer the matter to the driving school office. Elliotts School of Motoring offers to all pupils the opportunity to transfer to another instructor if pupils are unhappy with their current instructor. Customer care

Pupil’s contract is between them and their instructor. In the rare event of any problem arising, pupils should resolve this with their instructor immediately. In the unlikely event that pupils are unable to reach a satisfactory conclusion, we will be happy to investigate further until the matter is resolved. Please note that we will require evidence of any financial transactions and lesson times before we are able to investigate. Therefore, it is imperative that your Driver Record (provided to you by your instructor) details are kept accurate and up to date.
